Affiliate Referral & Commission Policy

This Affiliate Referral & Commission Policy (“Policy”) governs participation in ACEND’s Affiliate Program (“Program”). By enrolling in or participating in the Program, you agree to comply with this Policy and all incorporated terms, including our Terms of Service and Privacy Policy, plus any program guidance provided in your affiliate portal/dashboard.

1. Program Overview

The Program is designed for creators, educators, community leaders, and customers who want to refer others to ACEND using a unique affiliate link and/or code and earn commission on eligible, verified referral sales.

2. Eligibility & Enrollment

To participate, you must:

  • Be at least 18 years old.
  • Provide accurate account and payout information.
  • Comply with all applicable laws and platform policies (including advertising and consumer protection rules).
  • Not be located in a jurisdiction where participation is prohibited or restricted.

We may approve or reject any application at our discretion.

3. Key Definitions

“Affiliate”: A participant approved for the Program.
“Customer”: A purchaser who completes an order on ACENDhealth.com.
“Affiliate Link”: A unique tracked URL assigned to you.
“Affiliate Code”: A unique code entered at checkout.
“Qualified Purchase”: An eligible, completed purchase that is not excluded under this Policy.
“Net Sales”: Order subtotal (excluding shipping, taxes, duties, tips) minus discounts, refunds, chargebacks, and fraudulent orders.
“Commission”: Percentage-based payout on Qualified Purchases calculated on Net Sales.
“Chargeback”: A payment reversal initiated by a cardholder or payment processor.

4. Tracking & Attribution

A referral is attributed to you when a customer uses your Affiliate Link (cookie-based tracking) and/or your Affiliate Code at checkout.

4.1 Cookie Duration

Referral cookies remain valid for [30 days] from the customer’s first click unless cleared, blocked, overwritten, or otherwise unavailable.

4.2 Attribution Priority

If multiple referral sources are present, ACEND applies the following priority order unless otherwise stated in your affiliate portal:

  • Affiliate Code entered at checkout.
  • Most recent eligible referral cookie.

4.3 Tracking Limitations

Tracking may be affected by ad blockers, browser privacy settings, cookie deletion, incorrect link formatting, platform outages, or third-party tracking limitations. We are not responsible for tracking failures outside our reasonable control.

5. Commission Structure

5.1 Commission Basis

Commissions are calculated on Net Sales for Qualified Purchases. Shipping, taxes, duties, and tips are excluded.

5.2 Commission Rate

Affiliate commission is [Insert %] of Net Sales unless otherwise stated in your affiliate portal.

5.3 Coupon/Code Rules

Your affiliate code must not be posted on coupon aggregation sites, deal forums, or promo-code databases unless explicitly approved in writing. Unauthorized code sharing may result in commission forfeiture and removal from the Program.

6. Payouts

6.1 Payout Schedule

Payouts are issued monthly, typically within [15–30] days after the close of the month to allow for returns, cancellations, and chargebacks.

6.2 Minimum Payout Threshold

We may require a minimum accrued balance of [$50] before issuing payout.

6.3 Payment Method

Payouts are made via [PayPal / bank transfer / Stripe Connect / other] as configured in your affiliate portal.

6.4 Taxes & Reporting

You are responsible for all applicable taxes arising from commissions. You may be required to submit tax forms (e.g., W-9) if you meet reporting thresholds.

7. Returns, Refunds, Chargebacks, and Adjustments

If an attributed order is refunded, partially refunded, cancelled, or charged back, related commission may be reversed or deducted from future payouts and/or deemed ineligible as a Qualified Purchase. ACEND reserves the right to withhold payouts if we reasonably suspect fraud, policy violations, or abnormal purchase behavior.

8. Prohibited Conduct (Strict)

You may not:

  • Use misleading claims, fake testimonials, or “too good to be true” promises.
  • Make disease-treatment claims (e.g., “treats,” “cures,” “prevents”) or otherwise imply medical efficacy not permitted by law.
  • Spam or send unsolicited messages (email/SMS/DM) without consent.
  • Engage in cookie stuffing, bots, forced clicks, or incentivized clicks.
  • Purchase through your own link/code (“self-referral”) or encourage friends/family to do so for commission.
  • Bid on ACEND trademarks as paid search keywords where prohibited by our brand rules, or impersonate ACEND in ads or social handles.
  • Use misleading landing pages or imitate ACEND web properties.

9. Required Disclosures (FTC / Advertising Compliance)

You must clearly disclose your relationship with ACEND whenever you promote or refer, using plain language such as:

  • “I may earn a commission if you purchase through my link/code.”

Disclosures must be clear, conspicuous, and placed near the link/code in the same communication.

10. Intellectual Property & Brand Usage

ACEND grants you a limited, revocable, non-transferable license to use approved brand assets solely to promote ACEND under this Policy. You may not modify logos, create confusingly similar marks, or imply employment/partnership beyond your participation in the Program.

11. Suspension, Termination, and Enforcement

We may suspend or terminate your participation immediately if we determine, in our sole discretion, that you violated this Policy or applicable laws, generated fraudulent or low-quality traffic, harmed ACEND’s brand, customers, or partners, or engaged in prohibited conduct

Upon termination:

  • Your tracking may be disabled.
  • Unpaid commissions may be forfeited if linked to policy violations.
  • You must stop using ACEND brand assets.

12. Disputes & Commission Questions

If you believe a referral was not properly tracked, notify us within [30 days] of the order date and provide supporting details (e.g., affiliate code/link, date/time, and any available order information). ACEND’s tracking data and internal determination are final.

13. Policy Changes

We may update this Policy at any time. Updated terms will be posted with a revised Effective Date. Continued participation after updates constitutes acceptance of the revised Policy.
